Meeting
May 3, 2007

Peg Arguimbau Chairman, Hank Langstroth, Stephan Glicken, Janet Dunlap, Katherine Roth, and Christine Turnbull were the members present.

8:00 p.m. Abbreviated Notice of Resource Area Delineation Public Hearing filed by Old Post Road
                Development Realty Trust, to review the proposed wetland resource boundaries on the
            site  of the potential Sharon Commons Development adjacent to South Main Street & Old
               Post Road:
Ken Caputo, Bob Ingram, and Steve Campbell from Coler & Colantonio appeared before the Commission. Attorney, Bob Shelmerdine, for Old Post Road Realty Trust was also present. The green abutter cards were submitted to the Commission.
Ken Caputo reviewed a wetland delineation plan dated 4/19/07 of the proposed project site with the Commission. He explained that the Applicant proposes to design the Lifestyle Center as far away as possible from the environmentally sensitive areas of the proposed site. Representatives from Coler & Colantonio reviewed approximately 138 acres located east and west of Old Post Road. The Conservation Administrator met with Steve Campbell and Bob Ingram to review the proposed wetland lines, analyze soils, and the vegetation west of Old Post Road. The Conservation Administrator approved the proposed wetland lines west of Old Post Road with the revisions made to the delineated isolated wetlands. The Applicant proposes to submit an amended plan to the Commission to identify the relocation of the wetland flags.
The Representatives from Coler & Colantonio plan to arrange a site visit with the Conservation
Administrator to review the delineated wetlands on the large portion of land east of Old Post Road to be donated to the Town for a possible well site/open space. The Applicant intends to comply with Natural Heritage requirements concerning on/off site habitat mitigation on a large portion of the site from South Walpole Street to the bog area north of the site and east of the pond areas. The Applicant is seeking the Commission’s approval of the wetland boundaries for the proposed project before meeting with the ZBA on June 13, 2007.
Peg proposes to contact Morse Bros., concerning a plan for locating the lateral pipes of the Cranberry Bogs adjacent to South Main Street/Rte.95.
The DEP file number has not been issued yet for the proposed project.
Peg called for a motion to continue the Hearing until May 17, 2007 @ 8:00 p.m.

8:15 p.m. Old/New Business:

The Commission’s vote on the CPC’s proposed Town Meeting Article concerning the land purchase between Billings Street/Glenview Road:
The Commission discussed Article #13 of the May 7, 2007 Town Meeting for the appropriation of $500,000 for the acquisition of a 10.2 acre parcel between Billings Street/Glenview Road for land preservation and passive recreation purposes, and to delegate management of the property by the Conservation Commission.

Peg called for a motion to support Article # 13 with respect to the Billings Street parcel acquisition, and for the Commission to take all action as required.
Janet Dunlap moved. Hank Langstroth seconded. Voted. Unanimous.

Brickstone Sharon, LLC proposed Development Agreement:

Tim Sullivan from Brickstone appeared before the Commission concerning the development agreement for the proposed Sharon Hills project.
The Commission reviewed the proposed document and concurred to accept the terms of the development agreement as presented.
Stephan Glicken made a motion for Peg Arguimbau to sign, as duly authorized by the Commission, the proposed development agreement between the Town of Sharon and Brickstone Sharon, LLC.
Hank Langstroth seconded. Voted. Unanimous. 6-0-0.

Open Space Update:

Peg notified the Commission that the Open Space Survey is being re-drafted by the OSPC.
The members of the Commission discussed updating the following information:  
The language in the goal section of the survey
Parcels to consider for preservation
Ideas for making Conservation owned Land more accessible for public use

9:00 p.m. Signatures:  

The Commission signed bills. The Commission signed the Certificate of Compliance for
DEP File # SE-280-443, pending the Conservation Administrator’s inspection of the site.
Peg Arguimbau signed the Brickstone Development Agreement on behalf of the Commission.
